Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Indiana, USA. Any disputes related to these Terms will first be attempted to be resolved through negotiation. If unresolved, disputes will be subject to binding arbitration under the rules of the American Arbitration Association.

 

Miscellaneous

If any part of these Terms is held invalid or unenforceable, the remainder of the Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App and supersede and replace any prior agreements we might have had between us regarding the App.

 

Limitation of Liability

To the fullest extent permitted by law, Yogasleep and its affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (a) your use or inability to use the App; (b) any unauthorized access to or use of our servers and/or any personal information stored therein; (c) any interruption or cessation of transmission to or from the App; (d) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the App by any third party; (e) any errors or omissions in any content or for any loss or damage incurred as a result of your use of any content posted, emailed, transmitted, or otherwise made available through the App; and/or (f) the defamatory, offensive, or illegal conduct of any third party. In no event shall the aggregate liability of Yogasleep and its affiliates exceed the amount you paid Yogasleep, if any, in the past six months for the App giving rise to the claim.

 

Disclaimer of Warranties

The App is provided "as is" and "as available" without any warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance. Yogasleep does not warrant that (a) the App will function uninterrupted, secure, or available at any particular time or location; (b) any errors or defects will be corrected; (c) the App is free of viruses or other harmful components; or (d) the results of using the App will meet your requirements. Your use of the App is solely at your own risk.

 

Changes to the App

Yogasleep reserves the right to modify, suspend, or discontinue the App at any time, with or without notice to you. Yogasleep shall not be liable to you or any third party should we exercise such rights.

 

User-Generated Content

If the App allows users to submit content, such as reviews or feedback, you grant Yogasleep a non-exclusive, transferable, sublicensable, royalty-free, worldwide license to use, copy, modify, distribute, publish, and process any content you provide through the App, without any further consent, notice, and/or compensation to you or others. You represent and warrant that you have all the rights, power, and authority necessary to grant the foregoing license.

 

Jurisdiction-Specific Provisions

The laws of some jurisdictions may not allow the exclusion of implied warranties or the limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. In these jurisdictions, Yogasleep's liability will be limited to the greatest extent permitted by law.
